Okuchy, Inc. (Head office: 3-1-6, Motoazabu, Minato-ku, Tokyo; Representative Director and President: Ayumi Hata; hereinafter referred to as “Company”) hereby sets forth the Privacy Policy (hereinafter referred to as “Privacy Policy”) as follows regarding the handling of user information including personal information (including the information obtained by analyzing or processing the obtained user information, and hereinafter referred to as “User Information”) obtained in relation to the services (hereinafter referred to as “Service”) provided by the Company through the application software Zzz Meter (hereinafter referred to as “App”) and ancillary to the App. Also, “personal information” in the Privacy Policy refers to personal information as defined in Article 2 (1) of the Act on the Protection of Personal Information (Act No. 57 of 2003) (hereinafter referred to as “Personal Information Protection Act”).
The persons who applied for registration to use the App and who uses the App (hereinafter referred to as “User(s)”) are required to read through and consent to the details of the Privacy Policy when using the App. The User shall be deemed to have consented to the Privacy Policy at the point in time when the User presses the install button. If the User is a minor (including but not limited to when the User is under the age of 15 at the time of consenting to the Privacy Policy) who requires consent from a person with parental authority (guardian), the User shall use the App and input the User Information based on consent from the person with parental authority (guardian).
1.User Information Obtained and the Method of Obtaining
The Company may obtain the following User Information in relation to the use of the App by the User. However, depending on the App version or settings, all or part of the following User Information may not be obtained.

2.Purpose of use of the User Information
(1)The Company shall use the User Information for the following purpose of use.
- Enable use of the App by the User;
- Provide the Service, including analysis of the breathing sound;
- Provide information and respond to inquiries concerning the App and Service;
- Respond to violations of the Company’s terms of use, policies, special agreements, etc. concerning the App and Service;
- Improve and enhance the App and Service, as well as for the development of new services by the Company (including machine learning and other AI development);
- Research and development that contribute to fields including health management, medical treatment and beauty (including the analysis of related data), as well as commercialization of the outcomes thereof;
- In relation to the App and the Service, create statistical data in a form in which specific individuals cannot be identified;
- Provide the User Information to a third party in accordance with the provisions of the Privacy Policy; and
- Other purposes ancillary to the above purposes of use.
(2)The Company may, for the provision of the Service, use the User’s personal information duly obtained by the Company by means other than the App. Also, the Company may combine the User Information obtained in the App and such personal information and use the combined information within the scope of the above purposes of use.
3.Provision of the User Information to third parties
The Company may, within the scope necessary for achieving the purposes designated in paragraph 2, provide User Information to the company/ institution to which the User belongs (only when the usage fee for the Service used by the User is paid by that company or institution),as well as to researchers, universities, research laboratories, companies and institutions conducting research and development that contribute to fields including health management, medical treatment and beauty (including the analysis of related data) and the commercialization of the outcomes thereof.
The Company shall not disclose or provide User Information, including personal information, to third parties except in the cases set forth in the Privacy Policy, when consent is obtained from the User and when based on the Personal Information Protection Act or other applicable laws, regulations and guidelines.
4.Contracting the handling of User Information
The Company may, within the scope necessary for achieving the purposes of use stated in paragraph 2, contract all or part of the handling of User Information, including personal information, to a third party. In this case, the Company shall entrust the User Information to the contractor after taking measures to protect the personal information.
5.Information collection module
The App may obtain, transmit and accumulate User Information using the following information collection module, and provide the information to the third parties stated below within the scope necessary for achieving the purposes of use. Information collection module refers to a program provided by a third party which functions to obtain and analyze User information. The Company may combine the User Information obtained using the information collection module with information that identifies individual Users and use such combined information.
(1)Name of the information collection module: Google Analytics
Google Analytics, the information collection module provided by Google LLC, is incorporated in the App. The Company will, through Google Analytics, obtain, transmit and accumulate User Information (User ID, terminal information, and usage history of the App) through the use of cookie information in order to grasp the status of use of the App.

6.Method of obtaining consent, notification and announcement
(1)Use the App after confirming the Privacy Policy and consenting to the details thereof. At the point in time when you press the installation button for installing the App, you will be deemed to have consented to the Privacy Policy. Also, if you are a minor who requires consent from the person with parental authority (guardian), you are required to use the App after obtaining consent from the person with parental authority (guardian).
(2)The Privacy Policy can be found in the App, as well as places where the App is introduced, such as the application market and download page.
7.Suspension of obtaining User Information
The only way to suspend the acquisition of User Information by the Company (invalidate the consent to acquisition) is to uninstall the App. The Company may continue to use the User Information already obtained by the Company at the time of uninstallation.
8.Requesting disclosure
When the Company receives a request from the User for disclosure, correction, deletion or suspension of use of personal information in accordance with the provisions of the Personal Information Protection Act, the Company shall confirm the request has been made by the User and respond to such request without delay within the scope permitted by law.
9.Security control measures
The Company takes the necessary and appropriate measures for preventing the leak, loss or damage of personal information and other security management of personal information. 11.Revision of the Privacy Policy
The Company will review the status of operation as appropriate and strive to continuously improve the handling of personal information, and revise the Privacy Policy as necessary. When the Privacy Policy is revised, the Company shall notify the Users through a notification on the App. However, in the case of a revision for which the Company is legally required to obtain consent from the User, the Company shall obtain consent from the User through the method designated by the Company.
